NEW DELHI: Hearing a plea by 2020 northeast Delhi riots case accused Shahrukh Pathan alleging he was assaulted by jail officials, Delhi high court on Thursday asked him to move the trial court for an early hearing. The single-judge bench of Justice Amit Sharma said since a plea had already been moved before the trial court, it would be only appropriate if an application is moved before the court concerned. “You move an application for early hearing before the trial court. If nothing happens, we will see. We will give you the liberty,” said the court. The court was apprised that although a petition had been filed on similar lines in the trial court, the concerned judge had adjourned the matter for February 28 without passing directions for preservation of CCTV footage. The petition was moved in a case related to an incident in the 2020 riots wherein Pathan, a resident of north-east Delhi, was captured on camera pointing a pistol at policemen on Jaffrabad-Maujpur road. The image had gone viral on social media. Pathan was arrested on March 3, 2020. He was charged under IPC sections related to rioting, destroying public property, disobedience to public servants, assault, attempt to murder and unlawful assembly and relevant sections of Arms Act.
