NEW DELHI: A court has issued a notice to the Delhi commissioner of police (CP) to show-cause as to why contempt proceedings be not initiated against him for non-compliance of orders in a gang rape case, saying a rape survivor was made to run from pillar to post for redressal of her grievances. The woman, who was allegedly gang-raped by two persons, lodged a complaint with the ACP subdivision of Sangam Vihar on March 28, but an FIR was not registered immediately, in gross violation of the law. Additional sessions judge Sandeep Yadav noted that the woman had to approach Delhi Commission for Women and other authorities. The woman said she had visited the police station several times, met the station house officer and other officials, and was made to sit there for a long time, but no action was taken. The FIR was ultimately registered on May 4, almost 36 days after the complaint was filed. “Thus, the victim was treated by police officials like an accused and that, too, in a case involving a gang rape,” the court said on August 31. On August 8, the court directed the DCP (south) concerned to conduct an impartial inquiry. The DCP filed a report, claiming that the woman couldn’t be traced, and hence, there was no delay on the part of the investigating officer in registering the FIR. On August 17, the court called the report nothing but an eyewash, after the woman submitted that she was not called by the DCP or any other police official after August 8. The court then directed the CP to conduct an inquiry. On August 29, the woman informed the court that she was called to the DCP’s office, but when she tried to talk about the alleged harassment, she was told she would be called for further inquiry, but no probe was conducted. Although the DCP concerned claimed that as per an administrative noting, a DCP can file a report under the signature of the CP after getting it approved by the respective joint CP, special CP and CP, the court said no such material was placed to establish this authority, and hence, the DCP concerned, prima facie, appeared to have committed an offence of forgery. It issued a notice asking why appropriate action won’t be taken against her.
