(File photo)NEW DELHI: BJP’s Shahnawaz Hussain, within hours of the Delhi HC ordering registration of a rape FIR against him, moved the Supreme Court. His advocate, Mohit Paul, told a bench headed by CJI N V Ramana that registration of an FIR against him based on an allegedly false complaint to frame him would lead to loss of reputation built over 30 years as a public figure. Hussain said in the Lalita Kumari case, the SC had ruled that when allegations involve a public figure, preliminary inquiry should be conducted as blind registration of an FIR against him is likely to have deleterious consequences on his image and career. Delhi HC’s Justice Asha Menon, while dismissing Hussain’s petition, had ordered, “There is no merit in the present petition. The petition is dismissed. The interim orders stand vacated. The FIR be registered forthwith. The investigations will be completed and a detailed report under Section 173 CrPC be submitted before the metropolitan magistrate within three months.” The trial court’s order for registration of FIR against Hussain was stayed by the HC on July 18, 2018. The stay, which continued for more than four years, was vacated by the HC on Wednesday with a direction to the Delhi Police to register an FIR and complete the probe in three months. The HC also criticised the Delhi Police’s inaction in registering the FIR. In his special leave petition in the SC, Hussain said he is being “wrongly and falsely implicated with a malicious intent and for mala fide reason and dishonest intention by the complainant… The HC erred by directing registration of an FIR without considering the reply filed by the police authorities, which totally exonerates the petitioner and holds that the complaint is false.” FOLLOW US ON SOCIAL MEDIAFacebookTwitterInstagramKOO APPYOUTUBE
